Particulars of Organization, Functions & Duties

[Section-4 (1) (b) (I)]

The "ODISHA STATE BEVERAGES CORPORATION LTD" (OSBCL) established on the 6th day of November 2000, is one of the fastest growing PSU that is predicted to generate Rs. 10,000 Crore of Excise Revenue on the line of transaction. Its objective is for efficient and effective distribution, import and export of IMFL, Beer and CL having social responsibility while adhering to legal and financial propriety. This is a company fully owned by the Govt. of Odisha with paid up capital of Rs. 1 crore and authorized capital of Rs. 5 crore. It has vision and mission to augment Government Revenue even during the challenging time.

Under Section 20-A of Bihar and Odisha Excise Act, 1915, and by virtue of a notification no. 514/Ex . dated 31.1.2001 of Government in Excise Department, the right to carry on the importing, exporting and the wholesale trade and distribution of foreign liquor in the State solely vest in OSBC Ltd.

The main purpose with which the corporation has come into being is:

The Corporation purchases IMFL/FMFL/ Beer/CL from suppliers/ manufacturers who are registered with OSBC. At its depot points, the corporation sells IMFL/FMFL/Beer/CL to the licensed retail vendors. The retail vendors include Licensees of OFF Shops (FL & CL) as well as ON Shops (Hotels, Restaurants, Bars etc.).

MANDATE OF OSBCL

The mandates of OSBCL are as follows:

2) To design and manage an efficient distribution system for supply of genuinely procured stocks of IMFL, FMFL, BEER, CL to the licensed retailers after obtaining due certification from the authorized Govt. laboratory.

3) To ensure supply of stock as per the BIS and FSSAI norms.

4) To extend cooperation for carrying out campaign against liquor/drug abuse and illicit trafficking under CSR head along with activities in health, education, skill development & cultural sectors.

5) To ensure timely supply of genuinely procured stocks from the registered suppliers to the licensed retailers.

2) To be recognized as an outstanding State owned Corporation engaged in business of wholesale distribution of the alcoholic beverages in the State of Odisha.

3) To export brands that are high in demand to outside State of Odisha after fulfilling the State's need.

The main purpose of this designation is to direct and control all the business operations. MD is responsible for giving strategic guidance and direction to the board to ensure that the Company achieves its financial vision, mission and long term goals. He keeps informing the Stakeholders about the developments with company’s objectives. He creates and report on business plans, monitoring its efficacy and progress. He continuously monitors the annual budget and ensures that sales targets are met.

MD consider the recruitment, appointment, transfer, removal, including appraisals and disciplinary measures, as well as to determine remuneration and welfare benefits of employees. He has the power to issue regulations on the Company’s Operations. He can grant and delegate powers to other persons to perform specific tasks. He carry out any other act as entrusted by the Board of Directors and Executive Committee.

He is responsible for developing strong relationships with customers, connecting with key business executives and stakeholders and preparing sales reports. The Chief Operating Officer (COO) is a senior executive tasked with overseeing the day-to-day administrative and operational functions of a business. The COO typically reports directly to the Chief Executive Officer (CEO) and is considered to be second in the chain of command. He also design and implement business operations. He establishes policies that promote company culture and vision. He oversees the operations of the company and the work of the executives. They are responsible for overlooking all the departments of a company like production, marketing and sales, research and development.

They set comprehensive goals for performances and growth. He will have to maintain the control of diverse business operations, as an experienced and efficient leader. The goal of the COO position is to secure the functionality of business to drive extensive and sustainable growth. He assists CEO in fundraising ventures. He manages relationships with partners or vendors.

Supply Management Policy:

The Supply Chain Management Policy which was effective from 01.01.2019 has been suitably amended taking into account the changes made in Odisha Excise Act, 2008 , Odisha Excise Rules, 2017, Excise Policy, 2020-21 and decisions made by the Board of Corporation in the meanwhile and the “Supply Chain Management Policy, 2020” incorporating these amendments is effective from 01.04.2020.

 With the implementation of Odisha Excise Act, 2008 and Odisha Excise Rules, 2017 w.e.f  01.04.2017 and introduction of GST w.e.f  01.07.2017 subsuming several taxes & duties such as Central Excise Duty, VAT, Service Tax etc and repealing of Entry Tax which have a bearing on Import and Transport of liquor.

The “Liquor Sourcing Policy, 2016-17” was renamed to “Supply Chain Management Policy” of OSBCL keeping in view that the scope of the Policy covers different aspects of Supply Chain applicable to the Corporation.

 Under Section 19 of the Odisha Excise Act, 2008 the Odisha State Beverages Corporation Ltd. is owned and controlled by the State Government is vested with the exclusive right of purchasing Foreign Made Foreign Liquor (FMFL), India Made Foreign Liquor (IMFL), Beer, RTD, Wine and Country Liquor (CL) from the manufacturers/suppliers and sell them to the licensed retailers throughout the state of Odisha on behalf of the State Government. Further, the amendments required in the existing Supply Chain Management Policy, following the changes in the Odisha Excise Act, 2008, Excise Rule, 2017, Excise Policy, 2020-21 and considering the implementation of the latest online module and the decisions taken by the Board of the Corporation in the meanwhile, have been incorporated in to this policy and the amended policy has been renamed as “Supply Chain Management Policy, 2020”. It came into effect on 1st April, 2020.

Excise Policy:

After careful consideration, the Government ordered that the Excise Fee, Excise Duty, and Margin Structure along with the Regulatory Guidelines for the year 2019-20 issued vide this Department letter No. 1161/Ex., dated 07.03.2019 and No. 3759/Ex., dated 26.07.2019 shall continue for another 3 (three) months ie., from 1st April, 2020 onwards till 30th June, 2020 with following changes in rates and guidelines as applicable.

  1. License tenure and license fee for Out Still Units, FL-OFF Retails, CL Retails(Clause 2.4.3 sub-clause 5, 6 and 7 of Excise Policy 2019-20)

FL-OFF Shop:

Licenses of FL-OFF shops shall be renewed for 3 months i.e April-June, 2020(1st Quarter of 2020)with 10% increase in C. Money, along with necessary formalities.

MGQ applicable in the year 2019-20 shall continue proportionately for the extension period i.e. April-June 2020 i.e. without any increase in quarterly MGQ compared to the same quarter of the last year. Further, Licensee will be given the opportunity to lift shortfall MGQ for the year 2019-20 during this extension period of three months to make up for the shortfall in lifting along with MGQ of the extension period.

ENA based CL Shop:

Licenses of CL shops selling ENA based country liquor shall be renewed for 3 months i.e April-June, 2020 (1st Quarter of 2020) with 10% increase in C. Money, along with necessary formalities.

MGQ applicable in the year 2019-20 is reduced by 15% for the extension period i.e. April-June 2020; i.e. 15% reduction in quarterly MGQ compared to the same quarter of the last year. Further, Licensee will be given the opportunity to lift shortfall MGQ for the year 2019-20 during this extension period of three months to make up for the shortfall in lifting along with MGQ of the extension  period.

Out-Still Shop:

Licenses of Out-Still shops operating in 21 Excise districts shall be renewed for one year i.e. 1st April, 2020 to 31st March, 2021 with 15% increase in existing C. Money, along with necessary formalities.

MGQ of OS shops will not be increased. The OS shops are allowed to meet the shortfall MGQ for the year, 2019-20 during the 1st quarter of 2020-21 along with the normal MGQ of the 1st quarter to make up the shortfall in MGQ of the year, 2019-20.

  1. Mohua Flower: Utilization for OS Manufacturers(Clause 2.11 of Excise Policy 2019-20)

Utilization fee/non-utilization fee on Mohua flower is increased by 20% over last year(2019-20)

  1. Wholesale License fee(Clause 2.13 of Excise Policy 2019-20)

OSBC Ltd. shall pay an annual non-refundable fee of Rs. 2.0 Crore towards wholesale license fee.

6. Additional Rounding off Excise Duty(AROED)

The liquor MRP in the State will be rounded off to next Rs. 10 to make cash transactions convenient at the retail outlets. The Excise Department will charge the Additional Rounding-off Excise Duty(AROED) where required at such a rate to ensure that the Liquor prices are rounded off to next Rs. 10.
This AROED shall be a part of MRP build-up just like Excise Duty and will be included in total Excise Duty payable while issuing the permits. It shall be applicable at such value and in a such a manner that after application of VAT and retailer margin on wholesale issue price, the MRP arrived is exactly a multiple of Rs. 10.

Given the current situation arising out of Covid-19 outbreak, it is decided that no physical application is requested to be submitted at Excise office for extension of licenses or renewal of licenses or registration of labels which are already functioning in the State.  All existing licenses/ registrations related to production like Distilleries, breweries, bottling units, micro-breweries, Out-still units etc. requiring environment clearances shall be renewed on annual basis. Similarly wholesale license, depot license, label registration, FL ON shops, bhang/Tari/Pochwai shops shall also be renewed/extended/registered on annual basis(as is the practice) automatically on payment of requisite fees/ security deposits including application fee, wherever applicable.
Automatic renewal is subject to conditions that no adverse report on any ground is received from Excise Department for such Licenses/ Registration for FL-OFF shops, CL Shops and OS Shops. The licenses of FL-OFF shops and CL shops would be extended for a period of 3(three) months only. In addition to the above consideration money each licensee must pay one time interest free security deposit equivalent to one month consideration money in case of renewal of their licenses.

All other Excise Fee, Excise Duty and Margin Structure along with the Regulatory Guidelines which are not mentioned explicitly above shall continue as per policy of 2019-20.
Typographical error(s) & inconsistencies, if any shall be clarified by Excise Department/Excise Commissioner in consonance with the Act & the Rules. The above guidelines are subject to changes, if any, due to Court directions or as decided by State from time to time.

ORGANIZATIONAL SETUP

The Corporation is under the administrative control of Excise Department, Government of Odisha. Head Office of the Corporation is located at Bhubaneswar and there are nine depots throughout the State for storing and carrying out wholesale distribution of IMFL, Beer and Country Liquor.

Board of Directors:

The BoD is the apex governing body of OSBCL. The Management of the Corporation is vested with a Board of Directors consisting of six Directors including the Chairman and Managing Director (MD).

MD, the Chief Executive of the Corporation is assisted by the General Manager (Administration), General Manager (Accounts & Audit), Chief Operating Officer, General Manager (Technical), Chief Manager (Finance), Manager (IT) and Asst. Managers at the HO and Branch Managers (BMs) and Assistant Managers (AMs) at depot level.

Besides, one Excise Officer in the rank of Sub-Inspector/Inspector of Excise is posted to each depot by the Excise Commissioner (EC) as Officer-in-Charge (OIC) to issue transport passes and to ensure release of requisite quantity of liquor carrying Excise Adhesive Label (EAL) as well as batch numbers and date of manufacture.

OSBC earns profit from Registration Fee, Margin Money, Cash Discount, late Fee, Bank Interest, Stockholding Charges and fee for Re-validation or cancellation of permit.
