Particulars of Organization, Functions & Duties

[Section-4 (1) (b) (I)]

1. Aims & Objectives of the Organization:

     The important aims and objectives of the Department are Quality control of Drugs , Consumer protection by exercising strict control and vigilance on the drugs which are being Manufactured and /or marketed, thereby ensuring drugs of standard quality, purity, strength, safety are available to the public at controlled prices. The enforcement wing is dealing with grant/ renewal of manufacturing licenses, blood banks, sales licences, inspections of manufacturing, blood banks, and sales establishments. Investigation of complaints and launching prosecutions in case of breach of law, drawing of drug/Cosmetics samples for the Purpose of Test or analysis to ascertain its quality, purity and strength and safety To strive for Pharmaceutical excellence and health by ensuring the availability of safe, effective and quality drugs to the public.

The District Drugs Control Administration in this district implements the following Legislations enacted by the Government of India.

2. Mission/ Vision:

     The Department regulates the Manufacture, distribution and sale of Drugs and Cosmetics in the district and ensures the availability of standard quality drugs to the public at the prices as fixed by the National Pharmaceuticals Pricing Authority. It also regulates the functioning of Blood Banks to ensure the availability of safe Blood to the needy.

3. Brief History and Background for its Establishment:

     Office of the Drugs Inspector, Odisha,Subarnapur Range Subarnapur, Dist.- Subarnapur was established on Dt. 01.10.2009 It is regulated and controlled by Drugs Controller, Odisha, Bhubaneswar. Directorate of Drugs Control Administration under Health & Family Welfare Dept.Odisha.

4. Allocation of Business:

     Drugs Inspector entrusted with the task of implementing and enforcing all the Drugs related legislation, which includes controlling the quality of drugs, manufactured and sold within the State as well as manufactured outside the State but sold in the State.

     The Drugs Inspector checks all the drugs stores and manufacturing premises in regular intervals and if he found any discrepancy he will report to the Licensing authority. On basis of the report they issue a show cause Notice to the proprietor and if he/ she unable to replay within a stipulated period of time or his justification is not satisfactory then the Licensing Authority may suspend the Drug License for certain period of time or even if may cancel the same.

     Conduct raid time to time to check & screen the Movement of drugs as per the provisions of Drugs & Cosmetics Act 1940 & Rules there under.

5. Duties to be performed to Achieve the Mission:

     We are responsible for the quality, safety, efficacy and rational use of drugs at controlled prices, monitoring the collection and supply of safe blood and blood components, scrutinizing the misleading advertisements to safeguard the interests of the unwary people.

      An Inspector can perform his duties as per the powers given under section 22 of D & C Act. And Rules there under.

     Sec 22. (1) Subject to the provisions of section 23 and of any rules made by the Central Government in this behalf, an inspector may within the local limits of the area for which he is appointed.

a) Inspect:

i) Any premises wherein any drug or cosmetic is being manufactured and the means employed for standardizing and testing the drug or cosmetic;
ii) Any premises wherein any drug or cosmetic is being sold, or stocked or exhibited or offered for sale, or distributed.

b) Take Samples of any drug or cosmetic:

i) Which is being manufactured or being sold or is stocked or exhibited or offered for sale, or is being distributed.
ii) From any person who is in the course of conveying, delivering or preparing to deliver such drug or cosmetic to a purchaser or a consignee;

c) At all resonable times, with such assistance, if any, as he considers necessary:

i) Search any person, who, he has reason to believe has secreted about his person, any drug or cosmetic in respect of which an Offence under his chapter has been, or is being, committed, or
ii) Enter and search any place in which he has reason to believe, that an Offence under this Chapter has been, or is being, committed or
iii) Stop and search any vehicle, vessel or other conveyance which he has reason to believe, is being used for carrying any drug or cosmetic in respect of which an Offence under this Chapter has been, or is being, committed.

     And order in witting the person in possession of the drug or cosmetic in respect of which the Offence has been, or is being, committed not to dispose any of any stock of such drug or cosmetic for a specified period not to exceeding twenty days, or unless the alleged Offence is such that the defect may be removed by the possessor or the drug or cosmetic, Seize the, stock of such drug or cosmetic and any substance or article by means of which the offence has been or is being, committed or which may be employed for the commission of such offence.

d) Examining any record, register, document or any other material object found with any person or in any place, vehicle, vessel or other conveyance referred to in clause(c). and seize the same if he has reason to believe that it may furnish evidence of the commission of an Offence punishable under this Act or the rules made there under.

e) Require any person to produce any record, register or other document relating to the manufacture for sale, or for distribution, stocking, exhibition for sale, offer for sale or distribution of any drug or cosmetic in respect of which he has reason to believe that an offence under this Chapter has been or is being committed.

f) Exercise such other powers as may be necessary for carrying out the purpose of this Chapter or any rules made there under.

     Sec22 (2) The Provisions of the [Code of Criminal Procedure, 1973 (2 of 1974)] shall so far as may be apply to any search or seizure under this chapter as they apply to any search or seizure made under the authority of a warrant issued under [section 94] of the said Code.

i) Every record, register or other document seize under clause (cc) or produce under clause (cca) shall be returned to the person,from whom they were seized or who produced the same, within a period of twenty days of the date of the seizure or production, as the case may be, after copies there of extracts there from certified by that person, in such manner as may be prescribed, have been take.

Sec 22 (3) If any person willfully obstructs in the exercise conferred upon him by or under this Chapter, or refuses to produce any record, register or other document when so required under clause (cca) of sub-section (1) he shall be punishable with imprisonment which may be extended to three years, or with fine, or with both.
