7(2)(c) appoint officers of the Excise Department of such classes and with such designations, powers and duties as the State Government may think fit.

As per the declaration, appointment and delegations of powers etc made by the State Government under the Bihar and Odisha Excise Act, the State Government in Part II-appoint

A Superintendent of Excise in every district who shall exercise the powers conferred and perform the duties imposed on an Excise Officer by or under the Act throughout the district for which he is appointed and shall in subordinate to the Collector, and subject to the general control of the Excise commissioner exercise in such district all the powers and perform all th duties conferred and imposed on the Collector by the provisions of the Act specified below:

Grant of passes under sub-section (2) of section 12

Grant of authorization under clause (c) of sub-section (2)of section 18 to posses intoxicants not obtained from a licenced vendor:

Grant of permits under clause (g) of sub-section (2) of section 18 and under clause (e) of proviso (4) to section 20 to use tari in the manufacture of bread

Grant of permits under sub-section (1) of section 19 for possession of intoxicants

Power to empower Excise Officers under clause () of section 24 to require licensees to weigh or test intoxicants

Publication of lists under sub-section (1) of section 31

Confiscation under sub-section (2) of section 67

Composition of offences under section 68 in respect of breaches of conditions of licence, permit or pass as general conditions applicable to such licence or properly liable to confiscation

Issue of warrant of arrest under section 71

Issue of warrant of arrest under section 72

Arresting or searching in person or directing arrest or search in his presence under section 73

Powers & Duties

The following Excise Officers who shall exercise the powers conferred and perform the duties imposed on them by or under the Act throughout the areas for which they are appointed and shall have rank in the order in which they are named below:

He will also attend to all other Government works assigned by the Supdt.of Excise from time to time

Powers & Duties

Inspectors will closely watch the working of the Sub-Inspectors employed within their jurisdictions in all branches of excise work and will see that shops are regularly inspected and proper steps are taken for detection of offences., Sub-Inspectors are bound to carry out all the instructions and orders of the Inspector and in all matters should first refer to the Inspector for advice and guidance. Instructions given by the Inspector should not be inconsistent with the orders passed by his superiors

An Inspector is primarily a supervising officer, but he has also power to investigate offences. He is in executive charge of the area to which he is appointed by the Collector and he has to supervise the actions of all Excise officers within that area.

He must thoroughly inspect every spirit, ganja and bhang warehouse situated within such area at least once in each month

He should either of his own accord or at the requisition of a Sub-Inspector under him take an active part in the detection of cases of which information was received by them and also in important cases seek the permission of the Courts concerned to conduct the prosecutions.

The Sadar Inspector when at headquarters will attend the Excise office and compare the entries in chalan register with chalans and do such other works during the absence of the Superintendent from headquarters as the Superintendent may think necessary and permit.

He must inspect all excise and opium shops in his jurisdiction at least once in every six months

He must examine the records kept by the Sub-Inspector every six months at least. The Inspection notes will be forwarded to the Superintendent of Excise who will bring to the notice of the Collector points, if any, which require his orders.

Sub-Inspector of Excise

Powers & Duties

As per provisions in Para 31 and 35 of Odisha excise Manual vol. Ill, to quote in

 

Each district will be parceled out into such convenient charges as may be advisable according to the number of Sub-Inspectors. The area comprising a number of such charges will be placed under an Inspector, Each Sub-Inspector's jurisdiction will be called a "charge". The distribution of officers in charges will be determined by the Superintendent. The charges should be conterminous with the ordinary boundaries of Police stations so far as possible, but a charge may comprise one or more Police Stations. The headquarters of each charge should be selected by the collector with due regard to rented houses available and the prevalence of illicit practices within the area. An officer must on no account leave his jurisdiction without the previous permission of his superior. If he is required to cross his jurisdiction to pursue an accused, who has committee any offence in his jurisdiction and is making an escape into an adjoining area in British territory, he may do so but he will at his earliest convenience inform his immediate superior of this. Such cases should be eventually brought to the notice of the Collector

Sub-Inspectors

Powers & Duties

The principal duties of Excise Sub-Inspectors are the following:

To detect offences against the excise, opium, dangerous drugs, sugar and salt laws.

To check movements of old convicts in their jurisdictions.

To take measures for the prevention of drunkenness.

To inspect shops licensed for retail sale of intoxicants and opium other than denatured spirit throughout their charges at least once a month. Tari and Pachwai shops should be visited once in two months. Denatures Spirit shops and premises of persons licensed to possess or sell dangerous drugs should be inspected quarterly.

To check the licensee's accounts.

To examine the weights and measures in use in excise and opium shops.

Designation

Duties of Sub-Inspectors

Powers & Duties

To detect malpractices resorted to by the licensee. They should not, however make test purchases for the detection of irregularis as they are every often challenged by the licensees, imputing motives to the Sub-Inspector. There is no possibility of such risk in case of bona fide purchasers, who are found at the shop at the time of inspection. A question to whom will generally elicit the correct information about the irregularities, if there be any. It should not be difficult for them to arrange for their visit to the shops at the time when sales to bona fide customers are made. Detection of irregularities by superior officers raises the presumption that the Sub-Inspector was either conniving at irregularities or was not sufficiently mindful of his duties.

To inspect passes g ranted for the conveyance of intoxicants, dangerous drugs and opium and to see that they do not cover articles for which duty or fee as the case may be, has not be paid.

To examine whether the sites of licensed shops are according to rules and orders.

To examine intoxicants, dangerous drugs and opium in transit, in stock, or after sale and see that they tally in quality and quantity with the entries on the pass, are not adulterated and rare not sold at other than the prescribed strengths and prices, if any.

To examine whether any particular intoxicant, dangerous drugs and opium is being consumed to an undesirable extent as compared with another article, e.g., whether foreign spirit is taking the place of country spirit or country spirit of pachwai.

To ascertain whether the facilities for obtaining intoxicants, dangerous drugs and opium are adequate, or whether the demand is being met illicitly.

To ascertain whether there is any undue increase in consumption and is causes.

To observe any fluctuation in the consumption of and the revenue derived from, any intoxicant, dangerous drugs and opium and ascertain the reason of such fluctuation and note it in the prescribed statement of comparative consumption in case of intoxicants and opium. Reasons should be given for fluctuation in excess of 10 per cent.

Briefly stated, the duties of all officers of the Excise department are to prevent and detect offences against the laws enforce as enumerated in paragraph 2, to inspect shops licensed by the Excise Department and to check illicit or improper practices on the part of licensed vendors, to supervise distilleries and ware-houses to discourage excessive indulgence in intoxicants, opium and other dangerous drugs and generally to perform such other duties as may be imposed on them from time to time by the proper authorities. In North-Odisha they have also the duty to ensure the proper collection the revenue. In South Odisha this duty is performed by the Revenue staff.

Procedure Followed in Decision Making Process

     The procedure can be described both in narrative form and through flow process chart. In narrative form the stages through which a proposal passes, the levels at which it gets ans the final authority to which it has to go for approval may be explained.

     The flow process chart can give a comprehensive process as may be seen from the following illustration of preparing a food card.
