Particulars of Organization, Functions & Duties

[Section-4 (1) (b) (i)]

The concept of the Harekrushna Mahtab State Library was conceived during 1st Five Year Plan under the advice of Govt. of India and was completed in 1959 with a majestic building of around 16000sq. carpet area enshrined within a beautiful land of Ac.3.0 in a prime location of Capital City of Bhubaneswar. In 1967, it was named as Gandhi Bhawan commemorating birth centenary of Mahatma Gandhi, the Father of the Nation. The State Library was located in this building, but in a corner only till 1987. It was renovated by Prof. D. R. Kalia, the doyen of Public Library Service in India and the entire place of the four-storied building was utilized for functioning of two Libraries, i.e. State Library to act as the State Central Library, the Apex Library of the State Public Library System of Odisha and Bhubaneswar Public Library as the Apex Library of the City Public Library System for the City of Bhubaneswar.

On 15th August, 1987, Government decided to rename the State Library and the City Public Library as "Harekrushna Mahtab State Library" after the name of Dr. Harekrushna Mahtab, the builder of Modern Odisha and "Bhubaneswar Public Library" respectively. The former is a reference and research library of the State of Odisha (lending of books is not permitted) whereas the latter is a Library for the city of Bhubaneswar with reading room services. These two libraries have been providing reader services to more than four hundred readers a day from 8.00 A.M. to 8.00 P.M., but at present from 10.00 A.M. to 5.30 P.M.

Organizational Pattern of HKM State Library:

From the organization point of view, the State Library has been divided into three main Divisions, viz., Administrative Services Division (ASD); Technical Services Division (TSD); Readers' Services Division (RSD).

1.Administrative Services Division (ASD):

ASD deals with the matters in connection with administration, establishment, finance, accounts, maintenance, etc. of F1KM State Library.

2.Technical Services Division (TSD):

TSD deals with all the technical activities pertaining to Book Selection, Acquisition, Classification, Cataloguing, Conservation, Binding, etc. Besides purchase, books are also received as gratis under the Press and Registration of Books Act, 1867 and from Raja Rammohun Roy Library Foundation, Koikata as well as other benevolent persons as gifts. Out of the two copies received under the Press and Registration of Books Act, 1867, first copy is sent to the Depository Section for preservation for posterity and compilation of Odisha State Bibliography and the other copy is sent to its respective sections for use of the readers. After processing, books are transferred to respective sections in the RSD for use of the readers.

3.Readers' Services Division (RSD):

RSD deals with registration of Life Members, registration and renewal of new and old members, organization of books, compilation of Odisha State Bibliography, reference services, circulation of books and periodicals, reprography services, etc. in various sections namely, Registration Section, Children Section, Subject Collection Section, Language & Literature Section, Serial Section, Reprography Section. The State Library comprises of Fine Arts Collection, Reference Collection, Area Studies Collection including National Collection, Odisha Collection (Lord Jagannath Cult and Culture Collection), Women Studies Collection, Tribal Collection, Depository Collection, Official Documents Collection, Corporate Publications, etc.

(d)  ''Council" means the Odisha Public Library Council constituted under section-3;

(e)  "Director" means the Director of Public Libraries referred to in section-7;

(f) "Director, Culture'' means Director of Culture, Govern­ment of Odisha;

(g) "District Library'' means a Public Library established as a District Library under sub-section (i) of section-10 ;

(m) "Library services" means the services provided by a Public Library in relation to lending of books and references, abstracts, bibliographies and indexes of books and access to information recorded by  electronic media;

(n) "Prescribed" means prescribed by rules made under this Act;

(o) "Public Library" means-

     (a) a library which  is open to  public and  established or : maintained by the  Government;

     (b) an aided library such as libraries functioning under or by other departments of Government open to the public and includes a Gandhi Pathagar with its branches and delivery   stations, If any, and any other library which may   be declared by Government, from  time to time, as a Public Library;

(p) "Public Library System" means an organic interlinking of all Public Libraries in the State into a network to facilitate library services in a systematic and organized manner;

(q) "Raja Ram Mohan Roy Library Foundation" means the Raja Ram Mohan Roy Library Foundation established by the Government of India for expansion of public library services in the country;

(r) "State Library" means the library established by Govern­ment at the State Capital which has been named as Hare Krushna Mahatab State Library;

(s) "Year" means the financial year. 

3. Constitution of Odisha Public Library Council-

(1) For the purpose of advising  the Government   on matters concerning the management  and development of public library system and library  services in the state, formulation of   training policies and programmes in relation to such system and services and such other matters relating thereto as may be prescribed, the Government may, by notification, constitute a council to be called the Odisha Public Library Council.

(2) The Council shall consist of the following members, namely: - 

     (a) the minister-in-charge of the Department of Tourism and Culture (Culture), Who shall be the Chairperson of the Council;

     (b) Secretaries to Government in the Department of Tourism and Culture (Culture), Higher Education, School & Mass Education, Revenue, Information & Public Relations, Panchayati Raj, Finance and  Information Technology.

     (c) Directorate, Public Libraries, Who shall be the member -Secretary; and

     (d) fifteen other members, to be nominated by Government as follows:- 

          (i) One from amongst the members of  the Odisha  Legislative Assembly;

          (ii) One from amongst the members of Parliament representing the state of Odisha or any Constituency thereof;

          (iii) One from amongst the Chairpersons of Zilla Parisad in the State;

          (iv) One Who, in the opinion of Government, is an  expert in publiclibrary system and library services;

          (v) One Who is the President or Secraterary  of any library association in the state and has rendered valuable services for the development of library movement and education; 

          (vi) one from amongst the teachers of Post-graduate Teaching Department of Library and Information Science of different Universities in the State.

Provided that the members specified in sub-clauses (iii) and (vi) shall be nominated on rotation basis in the manner as may be prescribed.

          (vii) three representatives of rural aided libraries from three Revenue Divisional of the State as may be nominated by concerned Revenue Divisional Commissioner;

          (viii) three eminent writers, of whom two shall be women, as may be nominated by the Government;

          (ix) two eminent parsons from outlying Oriya speaking tracts across the State bolder; and

          (x) one representative of the book publishers as may be nominated by the Government.

(3) The term of office of, the procedure to be followed in dis­charge of their functions by, and the manner of filling casual vacancies among members of the Council shall be such as may be prescribed.

4. Constitution of Public Library Authority-

(1) The Government shall, as soon as may be, after the commencement of this Act, by notification, constitute a  body to be called the Odisha  Public Library  Authority which shall   be a body Corporate having perpetual  succession and  a   common seal with power, subject to the provisions of this Act and the rules made there under, to acquire,  hold and dispose of property and to enter into contracts and shall, by the said   name,   sue and be sued.

(2) The Library Authority shall consist of-

     (a) The    Minister-in-Charge    of   the    Department of Tourism   & Culture (Culture), who shall be the Chairperson;

     (b) the Secretary to Government in the Department of Tourism & Culture (Culture), who shall be the Working Chairperson; and

     (c) Director, who shall be the Member-Secretary.

5. Powers and Functions of Library Authority-

     Subject to the provisions of this Act, the rules made there under and the general or  special direction, if any, of the Government, the Library Authority shall exercise the following powers and perform the following functions, namely; -

(a) to evolve and, subject to the approval of Govern­ment, finalize perspective plans for the development of public library system and library services in the State which shall be executed by it through the Director and to co-ordinate, and determine the standard of library services from Village level to State level;

(b) to sanction the opening of Public Libraries subject lo availability of funds;

(c) to decide policy for the selection and purchase of books required by Public Libraries in the State and, for that purpose, constitute sub-committees in such manner and consisting of such persons as may be prescribed;

(d) to set up such other sub-committees as may  be necessary from time to time to regulate its work;

(e) to approve   and   submit   to Government,  every year, the audited statements of accounts and utilizations certificates of its funds;

(f) to accept endowments, bequests, donations, grants and transfer of any movable and immovable properties made over to the Library Authority; and

(g) to exercise such other powers and perform such other functions as may be prescribed.

6. Powers and functions of Chair­person & Working Chairper­son of Library Authority-

  1. The Chairperson shall be the head of the Library Authority and he, or, in his absence, the Working Chairperson shall preside over the meetings of the Library Authority.
  2. The Chairperson   shall supervise the implementation of policies and programmes of the Library Authority and exercise such other powers and perform such  other  functions  as may be prescribed.
  3. The Chairperson may, in writings, delegate such of his powers   and functions as he may   consider necessary, to  the Working Chairperson.

7. Constitu­tion of Directorate-

  1. The Government shall, for the purpose of carrying out the objects of this Act, constitute a separate Directorate to be called the Directorate of Public Libraries, which shall be headed by the Director of Public Libraries referred to in sub-section (2) and shall consist of such other Officers and employees as may be prescribed by way of restructuring the posts attached to the Library Section of the existing Directorate of Culture of the Government and State Library with the staff continuing against those posts in the prescribed manner.
  2. The Director, Culture shall be the Director of Public Libraries.

8. Powers & Functions of Director-

Subject to the control of the Government, the Director shall -

(a) be responsible to implement the plans, policies, schemes and programmes of the Library Authority; and

(b) subject to the provisions of this Act, exercise such powers and perform such functions as may be prescribed.     

9. State Library-

  1. The Stale Library shall be headed by the Director   of Public Libraries who shall be not   below the rank   of a Class-I Officer.
  2. The State Library shall function as a reference library and not as a landing library in respect of the books there in except in cases  of inter-library  loans.

10. District & City Libraries-

  1. The Government  may,   by   notification,  establish  a District Library in the headquarters   of every  district and, for the  purpose   of this section, a District   Library established by Government prior to the commencement  of this  Act,  shall be deemed to be a  District Library established under this Act.
  2. Where the population of any city, town or any other urban area is two lakhs or more, the Government may, by notification, establish in that area a City Library or declare an existing library, which is established by it, to be a City Library, Notwithstanding that a District Library is already existing in  the concerned district.           

11. Constitution District Library Committee-

  1. The   Government may, by    notification,   Constitute, in   the prescribed manner,   a  Committee   in each district to be called  the District Library Committee to look after the manage­ment of library services in the   district.
  2. The term of office of, the procedure to be followed in discharge of its functions by, and the manner of filling casual vacancies among, members of the District Library Committee shall be  such as may be prescribed.

12. Odisha Public Library Fund-

(1) The  Library Authority shall have a fund called the Odisha Public Library Fund to which shall be credited-

     (a)  grants made   by Government, Raja  Ram Mohan  Roy  Library Foundation and other sources for the purpose of Library services  in the State;

     (b) Contributions, donations & gifts made by any person;

     (c) endowments, donations  and bequests   as may be made by any non-resident Indian any Corporate House; and

     (d)  interest on  fixed  deposits & receipts from any other source.

(2)  All   moneys   credited   to   the   Library   Fund   shall   be deposited in such Nationalized or Scheduled Banks or invested   in such manner and shall be operated in   such  manner, as   may  be prescribed.

(3) The   money   in the   Library   Fund  shall   be utilized for carrying out the purposes of this Act.

(4) The Director and expenditure shall   keep a proper account of the receipts and expenditure.

13. Accounts and Audit-

  1. The Director shall keep regular accounts of receipts to, and disbursements from,  the Library Fund, under the direction of the Chairperson of the Library  Authority,  in such manner as may be prescribed.
  2. The accounts of   the Library   Authority and   the   Library Fund shall be subject to audit under the Odisha Local   Fund Audit Act, 1948.                                                                                                   
  3. The audit report shall be presented by   the Director to the Chairperson and copy of the same shall be sent to the Government with a note of action taken on the report.

14. Reports and Returns-

     Every person who   is in charge of the   management of a Public Library   shall submit such reports and returns and furnish such information as the Director may from time to time require, to the Director or any other officer authorized by him in this behalf.

15. Inspection of Public Libraries-

     The Director or any other officer authorized by him or by Government in this behalf shall have power to inspect any   Public Library or any   institution attached   thereto, for   the purpose of satisfying himself that the provisions of this Act and   the rules or orders made there under are carried out.

16. Annual Report-

     The  Director   shall   within six months from the end of every year, prepare an annual report and the progress made by the Library Authority in providing library services in the State in   that year and submit it to  Government together with such information and particulars as may be prescribed which shall  be laid  on   the Table of the Odisha Legislative Assembly.

17. Transfer of Management and Amalgamation of Public Libraries-

     On  and after    the    commencement of this Act, the Government may, for the purpose of proper and effective management of Public Libraries in the State, by notification,-

     (a) transfer any  Gandhi Pathagar to   a   suitable   registered voluntary organization and make provision for grant-in-aid in respect thereof ; and

     (b) amalgamate two or more Public Libraries into a single Public Library, in accordance with the rules made under this Act.

18. Vacancies, etc. not to invalidate proceed­ings-

     No act or proceedings of the Council, Library Authority or a District Library Committee shall be invalid on the ground only of the existence of any vacancy amongst its members, or any defect in the constitution thereof.

19. Power to make rules-

  1. The Government may, by notification, make carrying out the provisions of this Act.
  2. In particular and without prejudice to the generality of the foregoing powers, such rules may provide for all or any of the following matters, namely :-  

      (a) other matters relating to public library system and library services in the State on which the Council may advise the Government under sub-section (1) of section 3;

     (b) the manner of nomination on rotation basis under the proviso to clause (d) of sub-section (2) of section 3;

     (c) the  term of  office  of the   (Council    procedure to be followed by it and the manner of filling casual vacancies therein under sub-section (3) of section 3;

     (d) provisions, if any, subject to which the Library Authority shall   exercise   its powers and perform its functions, manner and composition of sub-committees and  other powers and functions of the Library Authority under  section 5 ;

     (e) other powers and functions of the Chairperson of Library Authority under subsection (2) of section 6;

     (f) other officers and employees of the Directorate of Public Libraries, the manner of restructuring the posts and staff of the Directorate of Culture and the State Library under sub-section (1) of section 7 and the qualification and experience of other officers and employees of the Directorate;

     (g) powers and functions of the Director, under clause (b) of  section-8;

     (h) the manner of constitution of District Library Committee, the term of office of its members, the procedure to be followed in discharge of its functions and the manner of filling casual vacancies therein under section 11;

     (i) the Banks in which the moneys of the Library Fund shall be deposited, the manner in which such moneys may be invested including the manner of operation of such deposits and investments, under sub-section (2) of section 12;

     (j) the manner of keeping accounts of receipts to, and disbursements from, the Library Fund under sub-section (1) of section 13 ;

     (k) the information and particulars to be accompanied with the annual report of Library Authority under section 16 ;

     (l) the manner of transfer of Gandhi Pathagar and amalga­mation of Public Libraries under section 17;

     (m) the provisions governing the grant-in-aid to aided libraries and the eligibility therefore under clause (a) of section 2 and section 17; and

     (n) any other   matter  which  is  required  to be, or may   be, prescribed.

20. Power to remove difficulties-

     (1) If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Gazette, make such provisions not inconsistent with the provisions of this Act, as appear to it to be necessary or expedient for removing the difficulty:

Provided that no order shall be issued under this section after the expiry of a period of two years from the date of commencement of this Act.

     (2) Every order made under this section shall, as soon as may be after it is made, be laid before the Odisha Legislative Assembly.

AN ACT TO   PROVIDE FOR THE   ESTABLISHMENT OF A NETWORK OFPUBLIC LIBRARIES IN THE STATE OF ORISSA AND   TO   MAINTAIN,REGULATE, GUIDE, CONTROL, SUPERVISE, INTEGRATE AND CONSOLIDATE   THE   LIBRARIES   IN THE STATE AS ALSOTO PROVIDE   FOR   A COMPREHENSIVE RURAL ANDURBAN   LIBRARY SERVICE IN   THE   STATE ANDFOR MATTERSCONNECTED THEREWITH   OR INCIDENTALTHERETO.

BE it enacted by the Legislature of the State of Odisha in the Fifty-Second Year of the Republic of India as follows : -

1. Short title, extent and Commencement-

  1. This Act may be called the Odisha Public Libraries, 2001
  2. It extends  to the Whole of the state of Odisha.
  3. It shall  come   into   force on such date  as  the state Government may, by notification, appoint.

2. Definitions-

In this Act, unless the context otherwise requires, - 

(a) "aided library' means a library which is open  to public and declared by the Director to be eligible for grant-in-aid from the   Library Fund in accordance with   the roles made under this Act, and includes a library which is receiving grant-in-aid from Governments;

(b)  " book "Includes -

(i) every volume, part or division of a volume, pamphlet, in any language;

(ii) every sheet of music,  map, chart or plan  separately pinned or lithographed ; and

(iii) newspapers, periodicals,   paintings, film slides paper. manuscripts, palm leaf manuscripts,  micro-films and discs or tapes used   for  audio-visual  information  or electronic information  for the purpose of providing library services to the public;

(c)  "City Library" means a public   library   established   or declared as a City  Library under sub-section (2)   of section-10;

GUIDELINES FOR OPENING, OPERATING, ACCOUNTING AND UTILISING CORPUS FUNDS.

1. A "Corpus Fund for upgradation and strengthening of public Libraries" shall be created in the manner indicated below.

2. A sum of Rs.1.00 crore (Rupees one crore) only shall be invested as the corpus created in favour of the HKM State Library, Bhubaneswar. The corpus shall be administered by Director, HKM State Library and shall be deposited jointly by Director, HKM State Library and Librarian, HKM State. The funds shall be deposited as fixed deposit in any Nationalised Bank at Bhubaneswar. The fund shall be jointly operated by the Director and D.D.O., HKM State Library. A separate Savings Bank Account shall be opened jointly in favour of Director, HKM State Library and D.D.O., HKM State Library and the interest accrued on funds invested as corpus shall be deposited in the aforesaid savings Bank Account.

3. Corpus of Rs.20.00 lakhs (Rupees twenty lakhs) only for each District shall be created. The fund at District level shall be operated jointly by the District Magistrate and Collector and District Culture officer of the District. The amount of Rs. 20.00 lakhs shall be deposited in any Nationalised Bank at respective district Headquarters.

4.  Interest accrued on the corpus fund shall be utilized for the purpose as    prescribed by the Govt. in Department of Culture from time to time. A separate cash book maintained for the purpose. Interest accrued open the corpus fund shall be deposited in a savings Bank's Account to be opened and operated jointly by the Collector and the D.C.O., Proposal for utilization of interest shall be sent by the Collector to the Director, Culture for approval and no expenditure shall be incurred out of this fund without approval of the Director, Culture.

5. Accounts of the corpus fund shall be maintained by the District Culture Officer of D.C.O., in-charge of the respective district and the D.D.O. of HKM State Library as the case may be.

6. The accounts shall be subject to audit by Department of Finance and A.G. Odisha.

7. Report on funds position as well as its utilization shall be submitted to the Director, Culture by the DCOs of respective districts and the D.D.O. of the HKM State Library in prescribed format.

8.  The Director, Culture shall have power to solve operational difficulties in respect of   utilization of interest accrued from the corpus fund.

9. No diversion of either the corpus fund or the interest accrued thereon shall be permissible. Funds must not be utilized for any other purpose than the strengthening and up gradation of libraries i.e. for purchase of books, periodicals, repair and purchase of furniture and binding of books periodicals for District and other Libraries under the jurisdiction of the District Magistrate and Collector of the district and for State Library under Director, HKM State Library     respectively.

PROCEEDING OF THE MEETING OF THE BOOK SELECTION COMMITTEE FOR SELECTION OF BOOKS FOR THE HKM STATE LIBRARY, DISTRICT & INTEGRATED LIBRARIES FOR THE YEAR, 2020-21 HELD IN TECHNICAL SERVICE DIVISION OF HKM STATE LIBRARY ON 22.02.2021 & 23.02.2021

A meeting of the Book Selection Committee was held under chairmanship of the Director & Addl. Secretary to Govt., 2021 in Technical Service Division of HKM State Library  For selection of books for the year, 2020-21 for the HKM State Library, District and  integrated Libraries under the Odia Language, Literature & Culture Deptt. Apart from the Director & Addl. Secretary to Govt., the following Members were present in this meeting.

Initiating the discussion, the Director & Addl. Secretary apprised the Members of the Committee about the funds available for purchase of books for the HKM State Library, District and Integrated Libraries, No. of copies of the selected books to be purchased, rates of rebate for the Career Development Books and Other books and norms of selection.

The sample books for selection were invited through advertisement in ‘’The Pramaya’’ and ‘’The Pragativadi’’ . It was resolved to increase the rate of rebate on Career Development Books for the HKM State Library and District & Integrated Libraries to 25% and 30% respectively. After through scrutiny of the submitted books, the books were selected for the HKM State Library, District and Integrated Libraries  in the following manner.

2.The Non-Official Members of the Committee are entitled for TA and DA as admissible for the First Grade Officers of the State Government as per the latest Finance Department Circular.

 

ORDER: Ordered that this Notification be published in the next issue of the Odisha Gazette.

Out of 484 books submitted for the HKM State Library, 114 books on 'Career Development' and 219 books on 'Other Subjects' were selected at total value of Rs.45,054/- and Rs.2,19,068/- after rebate of 25% and 10% respectively. Thus, the total value of the selected books

for the HKM State Library was Rs.2,64,122/- after rebate.

Similarly, out of the 289 books submitted for the District and Integrated Libraries, 17 books on 'Career Development' and 35 books on 'Other Subjects' were selected for the 20 District Libraries at total value of Rs.5,342/- and Rs.4,661/- after rebate of 30% and 20% respectively per single copy of the above books. Thus, the total value of the selected books for the 20 District Libraries was Rs.2,00,060/- after rebate and this value would be limited to Rs.2,00,000/- (Rupees Two lakh).

Likewise, 11 books on 'Career Development' and 16 books on 'Other Subjects' were selected for the 06 Integrated Libraries at total value of Rs.3,030/- and Rs.2,001/- after rebate of 30% and 20% respectively per single copy of the above books. Thus, the total value of the selected books for the 06 Integrated Libraries was Rs.30,186/- after rebate and this value would be limited to Rs.30,000/- (Rupees Thirty thousand).

With these, the meeting of the Book Selection Committee ended with thanks to the Members for their sincere cooperation to accomplish smooth selection of the books.

Process of Membership

The objective of registration of membership is to know the number of readers who have become members of this Library for their regular study. The more number of readers enrolled, it proves more prolific use of this Library. Besides, it is an honour for the elite mass to become members of this Apex Public Library in Odisha. Keeping in view the keen interest of some of the bonafide readers, life membership has been introduced.

The eligibility criteria for becoming members of the State Library, Bhubaneswar Public Library, Children Section and Life Membership are different. For becoming members of the State Library, one should be Post Graduate and prosecuting M. Phil, or Ph. D. degree or research or should be in service or retired qualified persons. One should have passed HSC or Class-X Examination for becoming member of Bhubaneswar Public Library. Children reading in Class-I to X can become members of Children Section. The citizens in the following fields namely Teacher, Author, Poet, Novelist, Dramatist, Lyricist, Musician, Dancer, Researcher in any field, Press Reporter, Essayist, Columnist, Script Writer, Film Producer, Film Director, Established Artist, Doctor, Engineer, Advocate, Entrepreneur. Company Executive, Tax Consultant, System Analyst and Investment Consultant.

In order to know the eligibility criteria for different memberships, application fee, caution deposit and procedure for membership, the intending readers may contact with the Registration Section. The application fee is Rs.15/- for State Library, Bhubaneswar Public Library, Children Section and Life Membership.  But the caution deposit varies for the above membership such as Rs. 200/- for State Library, Rs.100/- for Bhubaneswar Public Library, Rs. 50/- for Children Section and Rs.1000/- for Life Membership. Except the life membership fee, the caution deposit against the State Library, Bhubaneswar Public Library and Children Section are refundable after expiry of membership. The application forms for becoming members of the aforesaid libraries are different. Copies of these application forms are enclosed for reference. The refundable caution money can also be withdrawn during the valid period. The caution money not claimed within six months of expiry of the identity cards or for any reason whatsoever shall lapse. The following documents need to be submitted while submitting the applications for becoming members:-

a)  Filled in introducer card, original receipt towards purchase of application form and payment of caution money.

b)   Two recent attested passport size photographs/ Attested photocopy of HSC Certificate and certificate of last qualification. In case of Research Scholars doing Ph.D., Ph D. Registration Certificate is necessary for becoming members of State Library. The filled in application should be deposited within thirty days of the date of purchase along with the documents described above. After receipt of the applications, they are checked and membership no. is assigned to each member and the name of enrolled members are entered in the register year-wise mentioning the validity of membership and receipt number and date towards payment of caution money.

The validity of membership of State Library, Bhubaneswar Public Library and Children Section is three years from the date of enrollment whereas in case of life members, membership  is valid till the concerned member is alive. There is no renewal after expiry of membership and in such case, the intending member will have to apply afresh for membership.
