Particulars of Organization, Functions & Duties

[Section-4 (1) (b) (I)]

1. Objective/ purpose of the public authority:-

Forensic Science Laboratory is a key player of the Criminal Justice delivery System, of the State. Exhibits pertaining to crimes are sent to this laboratory from all over the State for chemical examination. The Forensic Scientists after performing scientific examination submit their opinion to the concerned Courts of the State. Such reports are considered as an expert opinion as laid down in Section 293 Cr P C The Experts are often summoned by the Courts to depose evidence. Over the years, the importance of such scientific reports have grown immensely and at present the Forensic Science Laboratory has become an indispensable tool in the overall process of Criminal Justice Delivery System.

2) Mission /Vision:-

Statement of the public authority:- To use conventional and latest scientific techniques in a professional and dedicated manner in examining various types of exhibits referred to this organization for chemical examination and submit the reports to the Courts to contribute significantly as an important player of criminal justice delivery system in a continued and effective manner.

3. Objective of the Organization:- ,

a) The basic endeavor is to assist the Investigating Agency to prevent, detect and investigate crimes using scientific methods.

b) To ensure scientific developments of the forensic scientists in a sustainable manner.

c) To develop new methods and adopt new techniques so that the quality of scientific crime investigation improves over the period.

d) To strive in a continuous manner to develop knowledge, skill, attitude and scientific temper of scientists working in this organization.

e) To impart training to all the stake-holders of the criminal justice system.

f) To adopt scientific crime investigation and adopt new technologies.

g) To promote mutual coordination and cooperation not only with other Forensic Science Laboratories but also with the other Centers of higher learning and research.

4) Brief history of the Organisation and context, of its formation:-

The State Forensic Science Laboratory had made its humble beginning in the year 1962 at Cuttack and later, in the year 1971, was shifted to its present location at Rasulgarh, Bhubaneswar. At present, State Forensic Science Laboratory has following 9 (Nine) functional Divisions and each Division is headed by an Officer in the rank of Assistant Director.

c) DNA Division (This Division has started in State FSL, Bhubaneswar w.e.f 7.3.2015)

Apart from State Forensic Science Laboratory, Bhubaneswar there are three Regional Forensic Science Laboratories situated at Berhampur, Sambalpur and Balasore each headed by one Deputy Director.

There are 24 District Forensic Science Laboratories functioning in the following Districts:-

5. Main activities /functions of the Public Authority:-

To supervise the over-all activities of the organization.

6. List of services being provided by the public authority with a brief write-up on them: -
State Forensic Science Laboratory has 9 (Nine) functional Divisions, each headed by an Officer of the rank of Assistant Director.

The functions of the above Divisions are as under:-

a) Chemistry Division:-To carry out scientific test of verity of exhibits for chemical examination.

b) Toxicology Davison: -To carry out scientific examination of viscera and other toxicological tissues for the identification of poison.

c) Biology Division: -To carry out biological examination of various types of body fluids and tissues.

d) Serology Division:-To determine species origin and also the blood groups of various biological materials.

e) Physics Division: - To carry out physical examination of various types of physical evidence, such as soil, paint, dust, etc.

f) Ballistics Division: -To carry out examination of fire arms and ammunition.

g) Lie-Detection Division:-To carry out polygraph test of the suspects, complainants, witnesses and the victims pertaining to various types of crimes.

h) DNA Division:- To generate DNA Profiles of various crime related exhibits like blood, semen, saliva, hair, nail, bone, teeth, tissues etc.

i) Cyber Forensic Division:- To carry out examination of digital exhibits.

The State Forensic Science Laboratory and the three Regional Forensic Science Laboratories are required to send reports duly signed by the Reporting Officer and the Chemical Examiner to the Courts. The Scientists also depose evidence in the Courts as and when summoned. This Laboratory has been declared as Recognized Research Institute by Utkal University, Bhubaneswar.

As per Information and Public Relations Department, Government of Odisha Notification No. RTI-140/17 7497/IPR.BBSR. Date 30/08/2017 State Forensic Science Laboratory, Odisha, Bhubaneswar and the organisations functioning under it have been exempted from providing any information to any applicant seeking information under RTI Act,2005. The notification reads as " In excercise of the powers conferred by sub-section (4) of section 24 of the Right to Information Act, 2005 (22 of 2005), the State Goverment do hereby specify that nothing contained in the said Act shall apply to the State Forensic Science Laboratory and organisations functioning under it".

DECISION
1. Appellant, Golak Parida is present. Srujan Prakash Das, PIO-cum-Assistant
Director, State Forensic Science Laboratory is also present. The written
memorandum filed by the PIO is perused and taken to record. Heard both the
parties and perused the case record.
2. The appellant had filed Form-A application dated 31.12.2012 through Registered
Post seeking information regarding the copy of the chemical examination report
referred to the Public Authority by the IIC, Gangapur Police Station, Dist. Ganjam
in FIR No.53(1) dated 07.07.2009. The PIO had rejected the information request
of the appellant through his letter dated 15.01.2013 on the ground that such
information was exempted under Section 8(1)(h) of the RTI, 2005. Being
dissatisfied with the information provided, the appellant had approached the First
Appellate Authority seeking his intervention in accessing the information. The
First Appellate Authority-cum-Director, State Forensic Science Laboratory,
Bhubaneswar vide his orders dated 21.02.2012 upheld the orders of rejection
passed by the PIO, for which, the appellant had approached the Commission for
their intervention through his present Second Appeal filed on 27.05.2013.
3. During hearing of the appeal the appellant has further alleged that since the
investigation of the particular case had already been completed and charge
sheet had been submitted to the competent court, the process of investigation for
all practical purposes had been over. Therefore the information sought by him
was no more exempted under Section 8(1)(h) of the RTI Act, 2005. Indicating
this, the appellant sought the direction of the Commission to the PIO to provide
the copy of the chemical examination report to him as per his request in the RTI
application.
4. The PIO in his response has submitted that after registration of the FIR, the
chemical examination is being done as per the orders of the competent court and
chemical examination report, in fact, had been submitted to the competent court
endorsing a copy to the Superintendent of Police and the concerned IIC.
Therefore, the information is now the property of the court, from which, the
appellant can access such information. Since the State Forensic Science
Laboratory, Bhubaneswar has no information regarding the present position of
the case and there was an apprehension that disclosure of such information may
hamper the trial of the case in the court, the information request was rejected
under Section 8(1)(h) of the RTI Act, 2005. Therefore, there has been no
deliberate refusal of the information to the appellant as alleged.
5. After hearing both the parties and on perusal of records, the Commission
observed that the very provisions under Section 8(1)(h) of the RTI Act, 2005
reads as follows:
“Not withstanding anything contained in this Act, there shall be no
obligation to give any citizen, the information which would impede the
process of investigation or apprehension or prosecution of offenders.”
6. In the present case as stated by the appellant, the investigation has already been
over and the charge sheet has already been filed in the competent court, but the
criminal case has not yet attained its finality. In the Law Lexicon the word
“prosecution” has been clearly defined indicating that “prosecution exists until
terminated in the final judgment of the court, to wit, the sentence, discharge or
acquittal.” It has been submitted by the PIO that at this stage the appellant can
access the information from the competent court, which is the custodian of the
information at present. Therefore, rejection of the information request of the
appellant under Section 8(1)(h) of the RTI Act, 2005 by the PIO as well as the
First Appellate Authority cannot be treated as unjust rejection of such information
request. Hence there is no necessity of interfering with the orders passed by the
First Appellate Authority in the present case. Consequently the Second Appeal is
disposed of being devoid of any merit.
