Particulars of Organization, Functions & Duties

[Section-4 (1) (b) (i)]

Particulars of Organization, Functions & Duties:

The Industrial Tribunal, Rourkela has been created by the Govt, of Odisha in the year 1995,under the Administrative control of erstwhile Labour & Employment Department and present Labour & ESI Department as an additional branch of Industrial Tribunal in addition to the Industrial Tribunal at Bhubaneswar for adjudication of the Industrial Disputes relating to any matter specified in second schedule and other functions, as may be assigned, under the Industrial Dispute Act, 1947(14 of 1947) in respect of territorial jurisdiction as specified by the Governement. Subsequently, it was declared as Heads of Department by the State Government. On joining of its first Presiding Officer, the Court and offices of the Industrial Tribunal, Rourkela so created was started functioning in the Multipurpose Labour Welfare Center Building at Rourkela.

The Teritorial Jurisdiction:

The territorial jurisdiction of Industrial Tribunal, Rourkela covers the revenue districts of Sundergarh, Sambalpur, Baragarh, Deogarh, Jharsuguda, Keonjhar, Bolangir, Soncpur, Kalahandi and Nuapada.

Powers & Duties of Officers & Employees

[Section-4 (1) (b) (ii)]

An Officer of Superior Judicial Service in the rank of District Judge (Super time scale) is appointed to function as Presiding Officer, Industrial Tribunal, Rourkela to adjudicate Industrial Disputes Cases referred by the State Government and also disposing of other incidental cases arising out of the Industrial Disputes Act. 1947 and other relevant laws.

Procedure Followed in Decision Making Process

[Section-4 (1) (b) (iii)]

The cases are being disposed of after hearing the parties at the Head Quarter as well as at Circuit Courts as far as practicable according to the convenience of parties and Tribunal. The aggrieved party can approach the Hon’ble High Court of Odisha by invoking the writ jurisdiction of the Hon’ble Court.

Norms for Discharge of Functions

[Section-4 (1) (b) (iv)]

The norm/ procedure of adjudication has been proscribed under the Industrial Dispute Act, 1947 and Rules framed there under so also the Odisha Industrial Dispute Rule, 1959 and as per the law laid down by the Hon’ble Supreme Court of India relating to such Act and Rules.
