Particulars of Organization, Functions & Duties
[Section-4 (1) (b) (i)]
1) Aims and Objectives of the Organization:
This Directorate aims at proper, impartial efficient and bonafide presentation of the case of Prosecution in different Criminal Courts of the State of Odisha.
2) Mission/ vision:
To increase the rate of conviction and ensure that no criminal goes unpunished for improper presentation of Prosecution.
3) Brief History & Background for its Establishment:
The conduct of prosecution in different criminal courts was in charge of investigating agency prior to the commencement of the criminal procedure Code, 1973. After introduction of new Cr.P.C. of 1973 conduct of prosecution by investigating agency was discontinued. As per Odisha Law Officers Rules, 1971 advocates were appointed by the State as Assistant Public Prosecutor, Additional Public Prosecutors and Public Prosecutors to conduct the Prosecutions. In order to exercise an effective control over the activities and performance of such prosecutors and to achieve better results, this Directorate was established in 1982. In the meantime the Odisha State Prosecution Service Rules, 1997 came into operation and some of the prosecutors (Cadre) were appointed by Govt. in different criminal courts being recruited by O.P.S.C. At present there are 217 such Cadre prosecutors working in different courts of the State. This Directorate exercise administrative control over the Cadre prosecutors being the Heads of Department under Home Department of Government of Odisha.
4) Organization Chart:
This Directorate acts as the heads of Department under the administrative control of Home Department of Govt. of Odisha. Director of this Directorate is an officer in the rank of O.S.J.S. (Senior Branch). The Special Officer of this Directorate is also a Judicial Officer in the Cadre of O.J.S-I, who assists the Director in administrative works. Besides that he is also functioning as D.D.O., Public Prosecutors are posted in different District Headquarters and their performance and establishment matter are dealt by this Directorate. However they are independently dealing with the prosecution of every case.

5) Allocation of Business:
In every Sessions Courts/ Addl. Sessions Courts in district in each district headquater one Public Prosecutors engaged to conduct the Prosecution of Sessions cases. Similarly in other sessions courts Cadre Addl. Public Prosecutors/ Associate Lawyers of non-cadre prosecutor are engaged to conduct sessions cases. In Magisterial Courts Act. Public Prosecutors are engaged to conduct criminal cases. As per O.S.P.S. Rules, 1997 Public Prosecutors allot Sessions and Criminal Courts to Addl. Public Prosecutors and Asst. Public Prosecutors respectively to conduct prosecution cases, subject to over all control and supervision, in the matter, by this Directorate.
6) Duties to be performed to achieve the mission:
a. Proper and bonafied presentation of prosecution by the prosecutors.
b. Securing the attendance of witnesses in time and making efforts for early conclusion of criminal cases.
7) Details of Services rendered:
Proper conduct of prosecution in all criminal cases instituted by State. Imparting necessary instructions and guidelines to the prosecutor to achieve the mission. Furnishing legal opinion for preferring appeal- and revision before the Hon'ble Court in the case of acquittal and other miscellaneous matters. Making efforts through prosecutors for early disposal of cases involving. Under Trial-Prisoner.
8) Citizens' Interaction:
Deals with the grievance petition of citizens for proper presentation of the prosecution in different courts.

10A.M. to 5.30 P.M. on all working days.

Allegations of improper conduct of cases by the Prosecutors if alleged by any public are dealt with properly.
12) Grievance Redress Mechanism:
The Director, with the assistance of the Special Officer takes care of all grievances by taking appropriate steps.

Procedure Followed in Decision Making Process
[Section-4 (1) (b) (iii)]
The Junior Assistants to whom the work is allotted submit a notes to the Section Officer mentioning the facts and action proposed. The Section Officer puts his observations thereon and passes the file to Special Officer. The Special Officer records his observation and suggest the course of action to the Director. The Director passes the final order on the subject.
