The Odisha Irrigation Rules, 1961

These rules are called as the Odisha Irrigation Rules, 1961. These rules to the extent they relate to any particular provision of the Act shall come into force on the date they are made or on the date of coming into force of the said provision, whichever is later.

The State Government may, by notification in the Official Gazette, apply the rest of the provisions of this Act, or any portion thereof to any local area or to any irrigation work or class of irrigation works, and may also, by a like notification subsequently exclude any portion of such local area or any such irrigation work or class of irrigation works from the operation of this Act, from such date as may be specified therein.

On the date of application of this Act or any portion thereof to any local area or to any irrigation work or class of irrigation works by a notification under section 2, such of the Acts specified in the Schedule and the rules and orders made thereunder as were in force in the area to which they apply and all laws, rules or orders in force and applicable to the areas other than those mentioned in the Schedule and now forming part of the State of Odisha shall in respect of that area or areas or any irrigation work or class of irrigation works, stand repealed:

Provided that such repeal shall not affect-

(a) the previous operation of the said Acts, rules and orders, or anything duly done or suffered thereunder; or

(b) any right, privilege, obligation or liability acquired, accrued or incurred under the said Acts, rules, laws or orders;

(c) any penalty, forfeiture or punishment in respect of any offence committed under the said Acts, rules, laws or orders; or

(d) any investigation, legal proceedings or remedy in respect of any such right, privilege, obligation, liability, forfeiture or punishment as aforesaid, and any such investigation, legal proceedings or any action for remedy may be continued, enforced or instituted with respect to any act previously done and any such penalty, forfeiture or punishment may be imposed as if this Act or any portion thereof had not come into force.

The Odisha Pani Panchayat Rules, 2003

In exercise of the powers conferred by section 43 of the Odisha Pani Panchayat Act, 2002, (Odisha Act 10 of 2002), the State Government do hereby make the following rules. These rules may be called as the Odisha Pani Panchayat Rule, 2003. They shall come into force on the date of their publication in the Odisha Gazette.

The Superintending Engineer of a Major/Medium/Minor Irrigation project shall delineation every Pani Panchayat area by issuing a notification to that effect observing the following stipulations, namely :-

(a) The Pani Panchayat area shall ordinarily cover an ayacut area between 300 to 600 hectares for a Major/Medium Irrigation project.

(b) In respect of Minor Irrigation Flow Project, the Pani Panchayat area may be less than 300 hectares as per the ground condition, but shall not be less than 40 hectares.

(c) Every Pani Panchayat area shall be a contiguous patch of land having a distinct hydraulic boundary. (d) The Pani Panchayat area shall avoid critical patches such as hills, rocks, sand dunes etc.  

In respect of Lift Irrigation Projects the entire commanded area of the project may as far possible form the area of a single Pani Panchayat, which shall be notified by the concerned Executive Engineer of Odisha Lift Irrigation Corporation observing the above stipulations as per sub-rule(1).

 Right of the Citizen in case of denial of Information and Procedure to Appeal:
All citizens shall have the Right to Information subject to provision of Right to Information Act, 2005. Where a request has been rejected under sub-section (1) of Section 7, the Public Information Officer shall intimate the applicant the reasons for such rejection in Form "C".

Memorandum of Appeal:
1. An appeal under sub-section (1) of section 19 shall be filled in form D to the officer as designated by the Public Authority as the Department Appellate Authority, i.e.; Executive Engineer, Minor Irrigation Division.

2. The memorandum of appeal shall be accompanied with such fee as specified in the schedule which shall be paid in the shape of court fee stamp.
3.  Any person aggrieved by the decision under sub-section (1) of section 19, may prefer a second appeal before the State Information Commission under Sub-section (3) thereof in form "E" which shall be accompanied with such fee in shape of court fee stamp as specified in the schedule.
5. Every order of Appellate Authority shall be communicated to the appellant concerned and to the Public Information Officer where such appeal is for the Order of the Public Information Officer and to the First Appellate Authority in Case it is a second appeal.
