1. The hand book carrying information relating to various activities carried out in the Directorate of Mines. Odisha in connection with the Right to Information Act.2005 has been prepared.

Particulars of Organization, Functions & Duties

Mineral Administration Wing
Odisha is endowed with vast resources of a variety of minerals and occupies a prominent place in the country as a mineral rich State. Abundant reserves of high-grade Iron ore, Bauxite, Chromites, Manganese ore along with other minerals such as Coal, Limestone, Dolomite, Tin, Nickel, Vanadium, Lead, Graphite, Gold, Gemstone, Diamond, Dimension & Decorative Stone etc. are extensively available in the State. This has opened up immense possibilities for locating mineral based industries for manufacture of Steel, Ferro-alloys, Cement, Alumina/ Aluminium, Refectories, Thermal Power etc., along with setting up other auxiliary and ancillary downstream industries.
The Steel & Mines Department is one of the important Departments of Government of Odisha. It works for the development of the mineral resources of the State under the regulatory powers. It also encourages and provides support for value addition and end-use of minerals in the State. Thereby creating facilities for employment, Socio-economic development and fetching more revenue for the State. The main functions and activities of the Department of Steel and Mines are systematic survey and assessment of the mineral deposits of the State, their exploitation, administration of mines and mineral concession, enforcement measures for prevention of illegal mining and smuggling of minerals, assessment and collection of mining revenue, study of the impact of mining operation on environment and research and development of areas and minerals for meeting the needs of mineral based industries in the State. The Steel and Mines Department is the administrative Department of the Directorate of Mines, the Directorate of Geology and Odisha Mining Corporation Ltd.
The main aim this public authority is to assess and collect mining revenue from the leased out proper mines, provides technical guidance to the lessees for scientific mining, keeps close watch for proper mineral administration, processing of prospecting licence & Mining Lease applications and checks illegal mining of transportation of its territorial jurisdiction.
Mineral Exploration Wing
The Directorate of Mines was created on 1.8.1955 under the Department of Industries in the State Govt. of Odisha. The Directorate of Mines was consisting of the geological survey and exploration wing and mineral administration wing.
In the Year 2022,Directorate of Mines & Directorate of Geology was merged and a new composite directorate of Mines & Geology fprmed vide notification No-9390/SM Dt.30.09.2022
Chemical Analysis Wing
To ensure proper and timely analysis of ores and minerals for accurate royalty assessment and to prevent mineral revenue leakage.
Odisha occupies an important position in the mineral map of India and is a treasure trove of rocks and minerals. A complete assay of the rock not only provides the basis for new geological exploration but also augments the state exchequer by means of revenue collection and royalty. This fundamental principle of development is the genesis of establishing the first analytical Laboratory in the Directorate of Mining & Geology in 1957 at Joda, the second Laboratory in 1960 at J.K. Road and the third Laboratory was set up at Bolangir in 1962. Subsequently the Research Laboratory at Bhubaneswar was established during 1966, Govt. Laboratory, Berhampur during 1976, Govt. Laboratory, Sambalpur during 1978 and Govt. Laboratory, Keonjhar was set up during 1983.
The duties performed by the analytical staff of the laboratory are highly scientific. During the process of analysis, the analysts use wide range of techniques which varies from traditional Wet Chemical Analysis to more advanced & sophisticated instrumental analysis and also adopt a various technical procedures prescribed by Indian Bureau of Mines, GSI and publications of other allied national and international institutions periodically.

5. Main Activities/Functions:
The main functions and activities of the Department of Steel and Mines are systematic survey and assessment of the mineral deposits of the State, their exploitation, administration of mines and mineral concession, enforcement measures for prevention of illegal mining and smuggling of minerals, assessment and collection of mining revenue, study of the impact of mining operation on environment, formulation of appropriate environmental control measures and research and exploitation of areas and minerals for meeting the needs of mineral based industries in the State and Country. The Steel and Mines Department is the administrative Department of the Directorate of Mines, the Directorate of Geology and Odisha Mining Corporation Ltd.
The Directorate also strives for ground water monitoring & its exploration for sustainable development of ground water Grant of exploration licenses, mining leases on minerals and petroleum to both public and private sector organization sources. The Directorate is also engaged in the work of geological disaster management like earthquake, landslides and any incidents time to time to mitigate the geological disaster as well as for its better preparedness.
The Directorate supports necessary administration and information to our leases and potential investors. Directorate deals with all queries regarding major and minor mineral potentiality and its mineral legislation apart from its procedure for grant of mineral concessions.
The Directorate is also responsible for the development and conservation of minerals.

Rules:
1. Mineral Auction Rules(Amendment) 20 March 2020:
In exercise of the powers conferred by section 13 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules to amend the Mineral (Auction) Rules, 2015.These rules may be called the Mineral (Auction) Amendment Rules, 2020. They shall come into force on the date of their publication in the Official Gazette.
In the Mineral (Auction) Rules, 2015, in rule 10, Provided that, in case of auction of mining leases under sub-sections (5) and (6) of section 8A of the Act, the vesting order issued under rule 9A of the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016 shall be applicable.
After sub-rule (6), the following sub-rules shall be inserted, namely:- “(6A) Notwithstanding anything contained in these rules, the mining lease shall be executed by the State Government within a period of fifteen days from (i) the date of issue of Letter of Intent to the new lessee to whom the vesting order has been issued under rule 9A of Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016; or (ii) commencement of the Mineral Auction (Amendment) Rules, 2020; or (iii) the expiry of the lease period of the previous lessee; whichever is later.
(6B)The holder of the Letter of Intent shall comply with all the requirements to execute the mining lease within the period referred to in sub-rule (6A), failing which, the Letter of Intent shall be revoked and the bid security or the performance security, as the case may be, and any installment of upfront payment paid shall be forfeited, and the preferred bidder or successful bidder may be debarred by the State Government from participating in the future auction of mineral blocks conducted under the provisions of these rules, for three years from the date of such debarment: Provided that on receipt of an application from the holder of the Letter of Intent, the State Government, may extend the period for execution of the lease deed by a further period not exceeding fifteen days, on satisfaction that such delay is entirely for the reasons beyond the control of the holder of Letter of Intent.”.
2. Mineral Concession (Amendment) Rules 2020:
In exercise of the powers conferred by section 13 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules to amend the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016.These rules may be called the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession (Amendment) Rules, 2020. They shall come into force on the date of their publication in the Official Gazette.
In the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016 (hereinafter referred to as the said rules), after rule 9, (9A) Conditions for issuance of vesting order and for obtaining rights, approvals, clearances, licenses and like under section 8B of the Act.-
(1) The State Government shall nominate a Secretary level officer of that State as the nodal officer, in respect of leases expiring under the provisions of sub-sections (5) and (6) of section 8A of the Act, within one week from the date of the notification of the Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession (Amendment) Rules, 2020.
(2) The nodal officer nominated under sub-rule (1) shall be authorised to collect all the valid rights, approvals, clearances, licences and the like vesting with the previous lessee and shall issue vesting order in favour of the new lessee along with the Letter of Intent.
(3) The vesting order issued under sub-rule (2) shall have the same terms and conditions of every rights, approvals, clearances, licenses and the like, which vested with the previous lessee: Provided that any statutory payments or documents to be submitted for obtaining such rights, approvals, clearances, licenses and the like for the period for which vesting right is issued, shall be made or done when the new lessee applies for issuance of the fresh rights, approvals, clearances, licences and the like under this rule: Provided further that mandatory payments towards certain statutory clearances shall be paid by the new lessee as specified by concerned authorities or the nodal officer.
(4) The vesting order issued under this rule shall be valid for a period of two years from the date of execution of new lease deed or till the date of getting all fresh approvals, clearances, licenses, permits, and the like, whichever is earlier.
(5) It shall be lawful for the new lessee to commence and continue mining operations on the land in which mining operations were being carried out by the previous lessee, after the execution of the lease deed for a period of two years as provided in section 8B of the Act: Provided that in respect of any land not owned by the State Government, the new lessee shall have the right to operate the mine, notwithstanding any claim or dispute by the owner of such land or the previous lessee, as the case may be and such claim or dispute shall be decided by the State Government, as per the extant laws.
(6) The new lessee shall immediately, but not later than one hundred twenty days from the date of execution of mining lease, apply afresh for all necessary rights, approvals, clearances, licenses and the like under the applicable statutes, rules or regulations, as the case may be, for obtaining the necessary clearances to enable further continuance of the mining operations beyond two years, in accordance with the proviso to sub-section (2) of section 8B of the Act: Provided that the new lessee shall continue mining operation as per the approved mining plan of the previous lessee till the new mining plan is prepared and submitted for approval.
(7) On submission of new mining plan, the new lessee shall switch over to the new mining plan and while undertaking mining operations as per the new mining plan, the new lessee shall conform to the approved quantity and the conceptual limit of mining plan held by previous lessee till the new lessee obtains afresh the requisite clearances, approvals, rights and the like.
(8) The new lessee shall inform the nodal officer about the submission of application in accordance with sub-rule (6), along with copies of such application and the new lessee may be facilitated to obtain approvals required for mining operations through the single window system established by the State Government: Provided that the final responsibility of obtaining the necessary approvals required for continuing the mining operations shall rest with the new lessee.
(9) No authority shall reject grant of any rights, approvals, clearances, licenses and the like to the new lessee on account of past violations or outstanding dues of the previous lessee, which may be agitated before appropriate forums separately without prejudice to any rightful legal claims of the parties.’
After rule 12 of the said rules, the following rule shall be inserted, namely:- “12A-Additional conditions for commencement and continuation of production as per section 4B of the Act.
(1) Notwithstanding anything contained in these rules, during the first two years from the date of execution of new lease, the holder of mining lease, to whom the order of vesting of rights, approvals, clearances, licences and the like have been issued under section 8B of the Act, shall maintain such level of production so as to ensure minimum dispatch of eighty percent of the average of the annual production of two immediately preceding years on pro-rata basis, failing which appropriate actions in accordance with the Mine Development and Production Agreement shall be initiated.
(2) The new lessee shall ensure that the annual production beyond two years from date of execution of new lease is equal to or more than the annual production by the previous lessee and shall subsequently workout and implement an annual production plan to ensure that the mineral resources are fully exploited during the period of the lease, failing which appropriate actions in accordance with the Mine Development and Production Agreement shall be initiated.”
In the said rules, for rule 18, the following rule shall be substituted:-
Auction of expiring mining lease.-
(1) The State Government shall, as per the procedure specified in the Act and the rules made there under, conduct auction of an expiring mining lease well in advance of its expiry so as to prevent disruption in production of minerals.
(2) The State Government shall endeavour to complete the auction process at least six months before the impending expiry of a mining lease so that there is a smooth transition from one lessee to the other; and the lease in such cases shall be executed after the expiry of the lease period of the existing lessee.
3. National Mineral Exploration Trust (NMET) Ammendment Rules 2018:
In exercise of the powers conferred by sub-sections (2), (3) and (4) of section 9C of the Mines and Minerals (Regulation and Development) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules to amend the National Mineral Exploration Trust Rules, 2015. These rules may be called the National Mineral Exploration Trust (Amendment) Rules, 2018. They shall come into force on the date of their publication in the Official Gazette.
In the National Mineral Exploration Trust Rules, 2015 (hereinafter referred to as the said rules), in rule 6, for subrule (2), the following sub-rule shall be substituted:
1.) The Fund shall be opened under the Public Account of India which shall be a non-lapsable and non-interest bearing account and shall be administered by the Central Government.
2.)The Fund shall comprise of payment of two percent equivalent of royalty payable by the holders of the mining lease or prospective licence-cum-mining lease under sub-section (3) of the section 9C of the Act.
3.)The Fund shall be utilized for carrying out the objects and functions as specified in rule 9, including carrying out regional and detailed exploration for minerals under the scheme, namely, ‘Regional and detailed exploration and related activities under Fund’.
In the said rules, for rule 7, the following rules shall be substituted,
(1) The holder of mining lease or prospecting license-cum-mining lease shall, while making payment of royalty to the State Government, pay to the Trust a sum equivalent to two percent of the royalty under sub-section (4) of section 9C of the Act by depositing the same in the Public Account of the State under the Head booked for this purpose.
(2) The State Governments shall transfer the amount so collected in the Public Account of the State under sub-rule (1) to the Consolidated Fund of India.
(3) The accretions in the Consolidated Fund of India shall be periodically transferred to the Fund by the Central Government, after due appropriation made by Parliament by law, in the financial year. (4) The responsibility of collecting and transferring the amount referred in sub-rule (1) to Consolidated Fund of India and maintaining necessary accounts in this behalf shall be that of the State Government and it shall transfer such receipts to the Consolidated Fund of India as early as possible and in any case, not later than the tenth day of the succeeding month in respect of the amount collected in any particular month.
(5) The State Government shall provide information regarding the amount collected under sub-rule (1) and the amount transferred to Consolidated Fund of India under sub-rule (2) to the Indian Bureau of Mines on a monthly basis.
(6) The Indian Bureau of Mines shall maintain an updated record of the amount transferred to the Consolidated Fund of India along with a database of royalty payments and provide such information to the Trust on a periodic basis.
In the said rules, in rule 8, for sub-rule (1), the following sub-rule shall be substituted:–
(1) The bank account of the Trust shall be closed as soon as possible after the publication of this notification and till such closure, the bank account of the Trust shall continue to be operated through the Member-Secretary or any other Member of the Executive Committee or any other officer of the Central Government as may be authorized by the Executive Committee.
In the said rules, in rule 19, in sub-rule (1), for the words “at the beginning”, the words “before the beginning” shall be substituted.
In the said rules, for rule 20, the following rule shall be substituted.
20. Annual Budget-
(1) The Member Secretary of the Executive Committee shall, before the beginning of each financial year, cause preparation of an annual budget containing the details of the proposed income and expenditure on activities covered in the annual plan for that particular financial year, including the legal, administrative and other costs and expenditure proposed to be incurred by the Trust together with details of funding requirements in this regard, to be referred as the Annual Budget.
(2) Annual Budget provision shall also be made in the Demands for Grants of Central Government under appropriate Head for incurring expenditure under Fund and equivalent amount thereof shall be met from the Fund.
(3) After due appropriation of fund and receipt of sanction of the Competent Authority, the expenditure under the Fund shall be incurred from the relevant sub-major or minor heads and on the basis of the sanction issued by the Central Government, the Pay and Accounts Office of the Central Government shall make the payment as per the General Financial Rules, 2017.
In the said rules, for rule 21, the following rule shall be substituted:-
21. Approval of the Annual Plan and the Annual Budget-
(1) The annual plan and the annual budget shall be laid before the Governing Body for its approval thirty days before the beginning of each financial year.
(2) Any amendment in the annual plan or the annual budget subsequent to the approval of the Governing Body may be done with the approval of the Executive Committee and informed to the Governing Body in its next meeting.
In the said rules, for rule 24, the following rule shall be substituted:
24. Maintenance and Audit of Accounts–
(1) The Pay and Accounts Office in the Central Government shall maintain a broadsheet of accretions to and payment from the Fund and effect reconciliation on monthly basis thereof with the concerned divisions and shall ensure that there are no adverse balances in the Fund at any point of time.
(2) The account of the Trust shall be subject to the audit by the Comptroller and Auditor General of India and also to audit by internal audit wing of the office of the Chief Controller of Accounts, in the Central Government.
4. S.O. 844(E), 19/11/1986 - The Environment (Protection) Rules, 1986:
In exercise of the powers conferred by sections 6 and 25 of the Environment (Protection) Act, 1906 (29 of 1986), the Central Government hereby makes the following rules. These rules are called the Environment (Protection) Rules, 1986.
The purpose of the Act is to implement the decisions of the United Nations Conference on the Human Environment. They relate to the protection and improvement of the human environment and the prevention of hazards to human beings, other living creatures, plants and property. The Environment (Protection) Act, 1986 authorizes the central government to protect and improve environmental quality, control and reduce pollution from all sources, and prohibit or restrict the setting and /or operation of any industrial facility on environmental grounds.
The standards for emission or discharge of environmental pollutants specified shall be complied with by an industry, operation or process within a period of one year of being so specified.
5.S.R.712(E), 18/11/1982 - The Air (Prevention and Control of Pollution) Rules, 1982:
In exercise of the powers conferred by section 53 of Air Prevention and Control of Pollution) Act, 1981 (14 of 1981) the Central Government in consultation with the Central Board for the Prevention and Control of Water Pollution hereby makes the following rules. ) These rules are called the Air (Prevention and Control of Pollution) Rules, 1982.
An Act to provide for the prevention, control and abatement of air pollution, for the establishment, with a view to carrying out the aforesaid purposes, of Boards, for conferring on and assigning to such Boards powers and functions relating thereto and for matters connected therewith.
6.S.R.58(E), 27/2/1975 - The Water (Prevention and Control of Pollution) Rules, 1975:
In exercise of the powers conferred by section 63 of the Water(Prevention and Control of Pollution) Act, 1974(6 of 1974) the Central Government after consultations with (Central Pollution Control Board), hereby makes the following rules. These rules are called as the Water (Prevention and Control of Pollution) Rules, 1975.
An Act to provide for the prevention and control of water pollution and the maintaining or restoring of wholesomeness of water, for the establishment, with a view to carrying out the purposes aforesaid, of Boards for the prevention and control of water pollution, for conferring on and assigning to such Boards powers.
7.S.R.23(E) - Forest (Conservation) Rules, 2003.
In exercise of the powers conferred by sub-section (1) of section 4 of the Forest (Conservation) Act,1980 (69 of 1980),and in suppression of the Forest (Conservation) Rules, 1981 except as respects things done or omitted to be done before such suppression, the Central Government hereby makes the following rules. These rules are called the Forest (Conservation) Rules, 203.
The rules shall extend to the whole of India except the State of Jammu and Kashmir. They shall come into force on the date of their publication in the Official Gazette. Additional Director General of Forests shall act as the Chairperson in the absence of Director General of Forests.
8. Granite Conservation and Development Rules, 1999:
In exercise of the powers conferred by section 18 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules for conservation and systematic development of and scientific mining to conserve, the granite resources and to prescribe a uniform frame-work with regard to systematic and scientific exploitation of granite throughout the country. These rules may be called the Granite Conservation and Development Rules, 1999. They shall come into force from the date of their publication in the official Gazette. These rules shall apply to prospecting and quarrying of granite. It shall be the duty of the mining engineer to take all necessary steps to plan and conduct mining operations, so as to ensure conservation of granite, systematic development of the granite deposits and protection of environment in and around the granite quarry lease area in accordance with these rules.
9. Mineral Conservation and Development Rules, 1988
In exercise of the powers conferred by section 18 of the Mines and Minerals (Regulation and Development) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules for conservation and development of minerals. These rules may be called the Mineral Conservation and Development. They shall come into force on the date of their publication in the Official Gazette.
The prospecting and mining operations shall be carried out in such a manner so as to ensure systematic development of mineral deposits, conservation of minerals and protection of environment. It shall be proved for absence or presence of underlying mineral deposits before it is brought into use for dumping.
10. Mineral Concession Rule, 1960
In exercise of the powers conferred by section 13 of the Mines and Minerals (Regulation and Development) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules. These rules are called the Mineral Concession Rules, 1960.
The State Government shall dispose of such applications as per provisions of these Rules: Provided that if a prospecting licence or a mining lease for other mineral has been granted to some other applicant within the area granted for a reconnaissance permit and where the reconnaissance permit holder discovers. Nothing in these rules shall affect the provisions of the Atomic Energy Act, 1962 (33 of 1962).
11. OMPTS Rules, 2007
In exercise of the powers conferred by Section 23C of the Mines and Minerals (Development and Regulations) Act, 1957 (67 of 1957), the State Government do hereby make the following Rules for prevention of theft, smuggling & illegal mining and to regulate the possession, storage, trading and transportation of minerals in the State of Odisha and for the puposes connected therewith. These rules are called as the Odisha Minerals (Prevention of Theft, Smuggling & Illegal Mining and Regulation of Possession, Storage, Trading and Transportation) Rules, 2007. They shall come into force on the date of their publication in the Odisha Gazette.
No person shall carry on the business of buying, possessing, storing, selling, supplying, transporting, distributing or delivering for sale or processing of minerals at any place for the purpose of sale or consumption or otherwise deal with any mineral except under and in accordance with the terms and conditions of a trading licence granted under these rules ;
Provided that a holder of a reconnaissance permit, prospecting licence or mining lease in respect of the minerals for which he holds a mineral concession shall not be required to obtain a licence for possessing, storing, selling, supplying, transporting, distributing or processing of such mineral(s) within the leasehold area and transportation from the leasehold area as the case may be :
Provided further that any person purchasing and transporting mineral(s) for use or consumption shall be required to obtain a licence or a permit as the case may be :
Provided also that no licence shall be required for transportation, storing and processing of minerals for scientific test or research work:
Provided also no licence shall be granted to any person unless a person is an Indian National or a Company as defined in the Companies Act, 1956; not a defaulter in payment of mining dues payable under the Act and the rules made thereunder and has not been convicted by a Court in any case relating to any violation under these rules:
Provided also that in order to discourage procurement of illegally extracted mineral(s) no licence for storage (depot) of mineral for trading shall be granted within a radius of 40 Km. of the source of such mineral :
Provided also that, no licence shall be granted to a person whose licence has been cancelled for violation of terms and conditions of a previous licence issued under these rules.
12. OMMC Rules 1990
In exercise of powers conferred by Sub-section (1) of Section 15 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the State Government hereby makes the following rules for regulating the grant of mineral concessions in respect of minerals and for purposes connected therewith.
These rules are called the Odisha Minor Minerals Concession Rules, 2004.
They shall come into force on the date of their publication in the Odisha Gazette.
Restriction on prospecting/mining/quarrying operation:
Restrictions on grant of prospecting licenses or mining/quarry leases or its renewal:
(a) there is evidence to show that the area for which the lease is applied for has been prospected earlier for decorative stone or the existence of decorative stones therein has been established otherwise than by means of prospecting such area, and,
(b) There is a mining plan duly approved by an authorized officer.
Maximum area for which a prospecting license, mining/quarry lease may be granted
(a) One or more prospecting license convening a total area of more than five hundred hectares for decorative stones:
Provided that the area granted under a single prospecting license shall not exceed one hundred hectares;
(b) One or more mining leases for decorative stones covering a total area of more than one hundred and fifty hectares;
Provided that the area granted under a single mining lease shall not exceed fifty hectares;
(c) one or more quarry lease covering a total area of more than one hundred hectares in respect of minor minerals:
Provided that the area granted under a single quarry lease shall not exceed twenty hectares.
Minimum area for which a prospecting license or mining lease may be granted or renewed
Provided that the State Government, if it is satisfied on the basis of proposed production level, geological or topographical conditions, may for the reasons to be recorded in writing, grant or renew a lease over an area more than the maximum area or lies than the minimum area.
Periods for which prospecting license, mining/quarry lease may be granted or renewed
13. OMPTS Amendment Rules, 2015.
In exercise of the powers conferred by Section 23C of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the State Government do hereby make the following rules further to amend the Odisha Minerals (Prevention of Theft, Smuggling & Illegal Mining and Regulation of Possession, Storage, Trading and Transportation) Rules, 2007. These rules are called ‘The Odisha Minerals (Prevention of Theft, Smuggling and Illegal Mining and Regulation of Possession, Storage, Trading and Transportation) Amendment Rules, 2015. They shall come into force on the date of their publication in the Odisha Gazette.
In the Odisha Minerals (Prevention of Theft, Smuggling and Illegal Mining and Regulation of Possession, Storage, Trading and Transportation) Rules, 2007, (hereinafter referred to as the said rules):—
(i) for the words “the Schedule” the word and figure “Schedule I” shall be substituted;
(ii) clause (h) shall be omitted;
(iii) after clause (k), the following clause shall be inserted, namely:— “(k-i) ‘Mineral’ means all major minerals and such of the minor minerals as may be specified by the Government”;
(iv) for clause (p), the following clause shall be substituted, namely:— “(p) ‘Trading license’ means a license of any category as specified in Schedule II of these rules, issued by the Competent Authority to any person, who wishes to possess, sell, trade in, transport, store or otherwise deal with any mineral.” 2
(v) In clause (q), after the words “by a carrier” occurring at the end, the words and letter “and includes e-transit pass”; shall be added.
14. Mineral Conservation and Development Amendment Rules-2016(19 April 2016)-1
The Ministry of Mines has prepared the draft rules named “The Mineral Conservation and Development Rules, 2016” under section 18 of the MMDR Act, 1957, for the conservation and systematic development of minerals and for the protection of environment and for purposes connected therewith.
In exercise of the powers conferred by section 18 of the Mines and Minerals (Regulation and Development) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules.
These rules may be called the Mineral Conservation and Development Rules, 2016. These rules shall come into force on the date of their publication in the Official Gazette.
These rules shall apply to all minerals except:–
(i) petroleum and natural gas;
(ii) coal, lignite and sand for stowing;
(iii) any mineral declared as prescribed substance for the purpose of the Atomic Energy Act, 1962 (33 of 1962); and
(iv)minor minerals.
Conservation and Development Rules, 2016” under section 18 of the MMDR Act, 1957, for the conservation and systematic development of minerals and for the protection of environment and for purposes connected therewith.
15. The Odisha District Mineral Foundation Rules, 2015
In exercise of the powers conferred by sub-section (4) of Section 15 and Section 15A read with Section 9B of the Mines and Minerals (Development and Regulation) Act, 1957 (Act 67 of 1957), the Governor of Odisha do hereby make the following rules to regulate the composition, functions and manner of working of the District Mineral Foundations and the amount of payment to be made to the District Mineral Foundations by the concession holders of minor minerals for the interest and benefit of persons and areas affected by mining related operations and for purposes connected herewith. These rules may be called the Odisha District Mineral Foundations Rules, 2015. These rules shall come into force on the date of their publication in the Official Gazette
The objective of District Mineral Foundation is to work for the interest of the benefit of the persons and areas affected mining related operations in such manner as may be prescribed by the State Government.
ln exercise of the powers conferred by sub-section (1) of Section 15 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the State Government hereby makes the following rules further to amend the Odisha Minor Minerals Concession Rules, 2004.These rules may be called the Odisha Minor Minerals Concession (Amendment) Rules, 2014. They shall come into force on the date of their publication in the Odisha Gazette.
In exercise of the powers conferred by section 13 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules. These rules may be called the Mineral (Auction) Rules, 2015. They shall come into force on the date of their publication in the Official Gazette.
The objective of the Mineral Auction Rules is that value of mineral dispatched. Where an area is being auctioned for more than one mineral, the percentage of value of mineral despatched as quoted by the successful bidder under sub-rule (3) shall be applicable for the purpose of payment to the State Government in respect of each such mineral.

These rules shall come into force on the date of their publication in the Official Gazette.
These rules shall apply to all minerals, except (i) minor minerals and (ii) minerals listed in Part A and Part B of the First Schedule to the Act. Nothing in these rules shall affect the provisions of the Atomic Energy Act, 1962 (33 of 1962) and the rules made there under in respect of licensing relating to atomic minerals listed in Part B of the First Schedule to the Act.
In exercise of the powers conferred by sub-sections (2), (3) and (4) of section 9C and section 13 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules.
These rules may be called the National Mineral Exploration Trust Rules, 2015. They shall come into force on the date of their publication in the Official Gazette.
The Trust shall carry out regional and detailed exploration for minerals and it shall undertake such activities as may be deemed necessary by the Governing Body to achieve its objects including,-
(a) funding special studies and projects designed to identify, explore, extract, beneficiate and refine deep-seated or concealed mineral deposits;
(b) undertaking studies for mineral development, sustainable mining adoption of advanced scientific and technological practices and mineral extraction metallurgy;
(c) taking up exploration of areas for regional and detailed exploration, giving priority particularly to strategic and critical minerals;
(d) consulting Central Geological Programming Board to decide the priorities for exploration of the Trust;
(e) facilitating exploration activities in such a manner that areas explored can be taken up for grant of mineral concessions in accordance with the provisions of the Act and the rules made thereunder;
(f) facilitating completion of brownfield regional exploration projects in obvious geological potential areas (G3) including conducting high-risk exploration for deep-seated mineral deposits through modern technologies;
(g) promoting completion of detailed exploration (G2 or G1) across India in the areas where G3 stage exploration has been completed;
(h) facilitating geophysical, ground and aerial, survey and geochemical survey of obvious geological potential areas and rest of India;
(i) facilitating a national core repository for encouraging research in earth sciences and for evaluation of the mineral prospects;
(j) organizing capacity building programmes to raise technical capability of personnel engaged in or to be engaged in exploration; and
(k) using the Trust Fund for such other purposes that the Governing Body may decide, or authorise the Executive Committee, to be necessary or expedient in the interest of conservation, development and exploitation of mineral resources of India, not inconsistent with the provisions of the Act.
Management of the Trust. –
(1) The overall control, periodical reviews and policy directions the Trust shall vest with the Governing Body.
(2) The Executive Committee shall manage, administer and supervise the day to day activities of the Trust.
(3) The Governing Body may authorise the Executive Committee to exercise any or all of its powers as mentioned in sub-rule (1).
(4) The Executive Committee shall formulate and finalise the scheme for delegation of financial powers.

Particulars of Arrangement in Formulation of Policy

Long term Linkage of Iron, Chrome Ore and other minerals to the MoU signed Steel Plant Companies of Odisha through M/s Odisha Mining Corporation Ltd.
Since more than 1/3rd of the iron ore reserve and over 90% of the country’s chrome ore deposits among other minerals are found in the State, the pro-active initiative of the State Government for Industrial Facilitation has attracted both the Domestic and Foreign Companies for setting up Mineral based industries in the State.
And whereas, in the process, out of the 49 nos. of MoUs signed by this Department with prospecting investors for iron and Steel Industries, already 31 nos. of units have either fully or partially started the production. Similarly, in case of Aluminum Projects, Government has signed MoU with few companies. These Industries having fulfilled their part of the commitment, are expecting the State Government to fulfill its part of the commitment especially with reference to making arrangement for meeting their requirement of raw materials.
The State Government have taken many initiatives as depicted below for ensuing raw materials supply to such industries, the assured availability of raw material particularly iron, chrome ore and other minerals has become a matter of concern.
The long-term linkage should be for 5 years.
Quantity to be assured under long-term linkage should be determined by a committee consisting of the following officials:-
(i) Secretary, Industries - Chairman
(ii) Director of Mines, Odisha - Member
(iii) CMD, IPICOL - Member
(iv) Chairman/MD, OMC - Member-Convener
While deciding the linkage quantity, production from captive mines, if any, shall be taken into consideration and the balance requirement only should be committed under long-term linkage.
IRON ORE LINKAGE:
(a) 50% of saleable stock will be placed under Long-term linkage for MoU–signed Steel Plants.
(b) The remaining 50% saleable stock shall be sold through National e-Auction to be conducted by OMC at an suitable intervals i.e. monthly / bi-monthly/quarterly.
(c) Weighted average price derived from the National e-Auction will be the long-term linkage price for the appropriate grades.
(d) MoU-signed Steel Plant with whom long-term linkage will be established by OMC can also take part in the National e-auction.
(e) Within the MoU- signed Steel Plants, Blast Furnace based integrated Steel Plants will be given priority over others.
(f) MoU-signed Steel Plants which are already in operation will be given preference over MoU-signed plants which are yet to be commissioned.
CHROME ORE LINKAGE:
(a) 70% of the saleable stock shall be made available for long-term linkage to State-based end-users.
(b) The remaining 30% of saleable stock shall be sold through National e-Auction.
(c) Weighted average price derived from National e-Auction shall be the long-term linkage price for appropriate grades.
(d) State–based end-user plants having long-term linkage can also take part in the National e-Auction.
(e) OMC will ensure requirement of Chromite supply to all State based industries.
Further, the sale agreement shall be executed in the Model Form ‘A’ for iron ore and in Model Form ‘B’ for chrome ore, as attached to this notification. The OMC will devise similar sales Agreement for other minerals like bauxite, manganese etc.
The main objective of the National Mineral Policy, 2008 is to have a more effective, meaningful and implementable policy that brings in further transparency, better regulation and enforcement, balanced social and economic growth as well as sustainable mining practices. The National Mineral Policy was first framed in the year 1993.
