1. Particulars of the Organization:
Asst. Labour Commissioner office, Govt. of Odisha, Balasore (Odisha)
2. Activity & Functions of the Office:
Enforcement of the following labour laws in the establishments/ organization which are coming under the state sphere.
i) Industrial Dispute Act, 1947ii) Industrial Establishments (S.O.) Act, 1946iii) Minimum wages Act, 1948iv) Odisha Shop & commercial Establishment Act, 1956v) Payment of Bonus Act, 1972vi) Contract labour Act (R&A) Act, 1970vii) Payment of Wages Act, 1936viii) Maternity Benefit Act, 1961ix) Working Journalist (C.S.) Act, 1955x) Motors Transport Water Act, 1961xi) Workmen's Compensation Act, 1923xii) Beedi & Cigar Workers (C.E.) Act, 1966xiii) Odisha Industrial Employment (N & F) Holiday Act, 1969xiv) Contract Labour (R&A) Act, 1970xv) Payment of Gratuity Act, 1972xvi) Inter state Migrant Workmen (RE&CS) Act, 1979xvii) Equal Remuneration Act, 1976xviii) Cine Workers & Cinema Theater Workers (RE) Actxix) The Labour Laws (Exemption from Furnishing Returns and Maintenance of Registers by Certain Establishments) Act, 1988xx) The Verification of Membership and Recognition of Trade Unions Rules, 1994xxi) Building and Other Construction Workers (CS & RE) Act, 1996xxii) Building & Other Construction Workers Welfare Cess Act, 1996xxiii) Deals with Complains and dispute under the industrial dispute Act, 1948 and ensure maintenance of better industrial relations in the establishments coming under the state sphere.xxiv) Deals with the complaints received from different industries regarding non compliance of provision of different labour laws.xxv) As Commissioners under the W.C Act, 1923, Controlling Authority under the Payment Act. Gratuity Act, 1972 and Appropriate Authority under the Minimum Wages Act, 1948 deals with the cases filed under the above Acts as per the provision of law and disposes of the same.
3. Duties Performed:
i) The Dist. Labour Officer, Asst. Labour Officers and Rural Labour Inspectors attached to this office who have been declared as Inspectors under the different labour laws inspect different coverable establishment periodically and ensure compliance of laws by the employers.ii) To enquire into the complaints received from different persons and organizations regarding violations of provision of above Acts and take suitable legal steps giving relief to the complaints.iii) To process the industrial disputes under conciliation and dispose of the same as per the provisions of the I.D Act, 1948.
